Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Spotnik ("Spotnik", "we", "us", or "our") and govern your use of the Spotnik mobile app and related services (the "Service"), a gym-buddy matchmaking app for finding workout partners near you. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years of age to create an account or use the Service. By using Spotnik, you represent and warrant that you are 18 or older, that you can form a binding contract, and that you are not barred from using the Service under applicable law.
2. Your Account
You sign in using a one-time code sent to your email. You are responsible for maintaining access to your email account and for activity that occurs under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.
3. Acceptable Use & Community Guidelines
Spotnik is built on respect. You agree to use the Service lawfully and to treat other members with courtesy. You agree that you will not:
- harass, bully, threaten, intimidate, stalk, or abuse any other person;
- post or send content that is unlawful, hateful, harassing, defamatory, sexually explicit, violent, or otherwise objectionable;
- impersonate anyone, misrepresent your identity or affiliation, or use another person's photos or information;
- solicit money from, scam, defraud, or spam other users, or use the Service for commercial solicitation without our permission;
- share another person's private or identifying information without consent;
- use the Service if you are a registered sex offender or have been convicted of a violent or sexual offense;
- attempt to access, scrape, disrupt, reverse-engineer, or circumvent any part of the Service or its security.
Zero tolerance for objectionable content and abusive users
Spotnik has a zero-tolerance policy for objectionable content and abusive behavior. There is no tolerance for content or conduct that is harassing, threatening, hateful, sexually exploitative, or otherwise objectionable. We review reports of objectionable content and abusive users, and we may remove content and remove or ban offending users — without notice — within 24 hours of a report where warranted. Users who engage in such behavior may be ejected from the Service and barred from creating new accounts.
4. Your Content & License
You retain ownership of the photos, profile information, messages, and other content you submit ("Your Content"). You are solely responsible for Your Content and represent that you have the rights to share it and that it does not violate these Terms or any law or third-party right.
You grant Spotnik a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute Your Content solely to operate, provide, and improve the Service (for example, showing your profile to other users and delivering your messages). This license ends when Your Content or your account is deleted, except for content already shared with others, content retained for legal or safety reasons, or residual copies in backups.
5. Reporting & Blocking
We give you tools to control your experience and to flag bad behavior. You can report any user or content and block any user directly in the app. Reported content and users are reviewed, and we may take action up to and including removing content and terminating accounts. Blocking a user prevents further contact through the Service. To report a safety concern that needs our attention, you can also reach us at support@spotnik.xyz.
6. Subscriptions, Purchases & Billing
Spotnik offers optional paid subscriptions (such as Spotnik+ and Spotnik Pro) and consumable purchases (such as Boosts and Super-picks). Purchases are processed through the Apple App Store or Google Play Store and are managed by your store account.
- Auto-renewal. Subscriptions automatically renew for the same period at the then-current price unless you cancel at least 24 hours before the end of the current period. Your store account is charged for renewal within 24 hours prior to the end of the period.
- Managing & canceling. You can manage or cancel a subscription at any time in your Apple App Store or Google Play Store account settings. Deleting the app does not cancel a subscription.
- Refunds. Payments are handled by Apple/Google, and refunds are subject to their policies. Except where required by law, purchases are non-refundable and unused consumables are non-refundable.
- Changes. We may change subscription features and pricing prospectively; changes will not affect a billing period already paid for.
7. Disclaimers
Spotnik helps you find workout partners, but we do not conduct criminal background checks and we do not guarantee the conduct, identity, or compatibility of any user. You are solely responsible for your interactions with other users. Always use good judgment, meet in public places, and prioritize your safety. The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
8. Limitation of Liability
To the maximum extent permitted by law, Spotnik and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service or your interactions with other users. To the extent a liability cannot be excluded, our total liability is limited to the amount you paid us, if any, in the twelve months before the event giving rise to the claim.
9. Termination
You may stop using the Service and delete your account at any time from Settings → Delete Account in the app. We may suspend or terminate your access at any time, with or without notice, if you violate these Terms (including our community guidelines), if needed to protect users or the Service, or as required by law. Provisions that by their nature should survive termination will survive.
10. Governing Law
These Terms are governed by the laws of the United Arab Emirates, without regard to its conflict-of-laws rules. You agree that the courts located in the United Arab Emirates will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where prohibited by applicable law.
11. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after an update means you accept the revised Terms.
